BARKFEST VENDOR TERMS + CONDITIONS

  1. Vendors and their staff are required to comply with all rules and regulations as established by BarkFest (herein called the Event) and Moon + Stars Productions + Publishing Inc. (herein called Management) for the Event taking place September 20 & 21, 2025 at Red River Exhibition Park (the Venue) in Winnipeg, Manitoba.

  2. Management has the right to accept or refuse any Vendor application, or to relocate Vendors to maximize use of Market Booth Space, and to maintain the quality, traffic flow and/or good order of the Event. Vendor agrees to comply with all rules or regulations implemented by Management, deemed necessary prior to, during and after the Event.

  3. Vendor space may not be shared, transferred or sublet without the written permission of Management. No part of the Vendor’s Booth Space will be used for display or promotion of any item or service other than what is noted on the vendor application, unless the items are provided by another official Vendor in the event.

  4. If Vendor fails to comply with payment terms and due dates, all rights of the Vendor shall be terminated and all payments received to date may be retained by Management as liquidated damages and not as penalty and Management may then reassign the space.

  5. If the Vendor needs to cancel its participation in the Event, the Vendor must give Management Notice in writing sent by email to hello@moonandstarsproductions.ca. not less than thirty (30) days prior to the Event date, in which case all payments paid to date by the Vendor shall be applied as a credit towards the Vendor’s participation in the Event taking place the following calendar year. Notice is not effective unless Management confirms the cancellation in writing. If the Vendor cancels its participation in the Event less than thirty (30) days prior to the Event date, the Vendor is responsible for any unpaid balance due and no refunds or credits towards the following Event year will be given.

  6. Booths must be set up during the times assigned (Move-In Friday 9am to 9pm) and Booths must be completely set up by 9:30am Saturday and always staffed during the Event hours (Event Hours Sat & Sun 10am to 5pm). No display may be dismantled or removed until closing on the last day (Event Close Sun 5pm). Vendor agrees to remove their display items from the Event building by final Move-Out time. (Sun 8pm). Vendors are responsible for leaving their Booth in a clean condition and properly disposing of any garbage from their Booths in designated garbage and recycling bins or be subject to venue charges.

  7. Any space which has been assigned to a Vendor which is not occupied, or for which no special latecomer arrangements have been made prior to 6pm the Friday preceding the first day of the Event, may be resold or reassigned by Event Management without obligation. All Booth displays must be set up by 9 pm Friday and ready for doors open 9:30am Saturday. Management reserves the right to reassign space not occupied by this time. 

  8. Event will take place Rain or Shine. If the Event is cancelled or postponed for any reason beyond the control of Management, Management shall in no way whatsoever be liable to the Vendor. Upon such a cancellation, Management shall be entitled to retain the Vendors payments to date as per paragraph 5 above. Management reserves the right to change the dates of the Event, at any time up to and including thirty (30) days prior to the then current Event dates, and in the event of such a change, shall not be liable for damages or otherwise by reason of such change.

  9. Management is not responsible for any liability connected with the acceptance of anyone choosing a Vendor’s product or service. The Vendor agrees to indemnify and hold harmless Management from any and all claims, causes of action, and suits arising out of or resulting from any damage, injury, or loss to any persons, including, but not limited to loss of property, goods, wares, or merchandise, caused by, arising out of, or in any way connected with the Vendor or the privileges granted herein. Vendor must take steps necessary to insure themselves against any such loss and agrees to provide proof of business liability insurance prior to the Event. In any insurance policy obtained by Vendor for this Event, Vendor must name BarkFest / Moon + Stars Productions + Publishing Inc. as an additional insured subject to a minimum $2,000,000 liability limit. Vendor is responsible for any damage to the building or fixtures caused by the Vendor or any of the Vendor’s agents or employees. Vendors are responsible for any loss of their display items and/or equipment resulting from misplacement, theft, accidental breakage, fire or natural disaster.

  10. Vendor Displays must comply with all Red River Exhibition Park Fire and Safety Regulations. All materials used for draping and decorations must be fire resistant or treated with a flame-retardant solution. Aisles must be kept clear at all times. Packing materials, boxes, cartons etc. cannot be stored in your Booth Space. Enclosed or covered structures (pop-up tents/canopies) must be approved by the Venue & Management and meet fire safety regulations. Vendors with tents/canopies must bring their own fire extinguisher to keep in their Booth Space.

  11. Vendor is responsible for ensuring that any sound level coming from the exhibit space or any apparatus shall not be at a level which will disturb surrounding Vendors.

  12. Solicitation or distribution of printed matter or samples is prohibited outside the confines of the Booth Space rented.

  13. Central Display is the Venue’s official Display Contractor. Items such as tables, chairs, carpet, lights, furniture, etc. may be rented from Central Display if needed, and electrical power may be ordered from the Venue. These items or costs are not covered by this contract.

  14. Vendor agrees to conduct all business in compliance with all statutes, bylaws, rules and regulations of any Federal, Provincial, Municipal, or any other competent authority.

  15. Vendor is responsible for obtaining and paying for all necessary licenses, permits, and certificates required by all authorities having jurisdiction including LGCA licenses, Manitoba Health Food Handling permits, and Direct Sellers License, and to pay all taxes eligible in connection with the business conducted within the space.

  16. The Event strives for high quality and creative Booth displays including professional signage. Booth wall dimensions should be 8-foot-high back wall, 3-foot-high side walls; corner Booths can have one open side. Pipe & Drape rental is optional for $35. If any part of your display is visible to your neighbor’s Booth, it must be covered or nicely finished or a draped back or side wall will be set up to cover it at the Vendor's expense. Helium balloons are not permitted.

  17. Vendors planning to have dogs at the Event must comply with the Event Rules & Dog Welfare Guidelines. Vendor must ensure that their dog is in good health, has proper vaccinations, is not of an aggressive nature, is not in heat, and, to the best of Vendor’s knowledge, is free from any diseases or conditions that would make it a danger to any individual. All animals must remain in the confines of the Vendor’s Booth display space during the event, with the exception of taking dogs on a leash no longer than 4 feet for breaks or to the designated Dog Potty waste stations outside when necessary. The venue floor is concrete, be sure to bring comfortable bedding/mats/crates and food and water bowls for your dogs to use while in your Booth.   18. To ensure responsible animal welfare best practices, the sale or adoption of animals during the event is not permitted, but Vendors may begin the adoption approval process to be finalized post-event after proper screening is completed. 


EVENT RULES + DOG WELFARE GUIDELINES

Help us make BarkFest (the “Event”) a safe and fun experience for all dogs and their humans (“Attendees”) by following these important Event Rules & Dog Welfare Guidelines:

  1. Limit one dog per adult Attendee (18 years of age or older). Dogs, and children under the age of 5, are free admission when accompanied by an adult. Free Re-entry Sunday if you request a wristband before leaving the Event on Saturday. Event will take place Rain or Shine.

  2. All Attendees entering BarkFest have voluntarily agreed to participate in the Event, which will include their attendance with their dog, along with other participants and their dogs, and agree to comply with all Rules and Guidelines for the Event as they apply to their dog, guests, and themselves.

  3. Attendees assume full responsibility for their dog and any risks, injuries, or property damage, and agree to release from liability, waive any and all claims against, forever discharge and hold harmless, Moon + Stars Productions + Publishing Inc., the organizers of the Event and their employees, the owner(s) and lessor(s) of Red River Exhibition Park, participating vendors and volunteers associated with the Event, of and from any and all claims for injuries, property damage, or loss of any kind in connection with their and/or their dog’s attendance at the Event.

  4. All dogs must be at least six months old, in good health, and have current required vaccinations (Rabies, DHLP, Parvo etc.). All dogs should have tags containing contact information worn while in attendance at the Event. Please do not bring a dog that is ill, behaving abnormally or is in heat. All Attendees agree to remove their dog from the Event if the dog becomes ill or is behaving in any abnormal or aggressive manner. Attendees agree to comply with the City of Winnipeg Responsible Pet Ownership By-Law including Prohibited Dog Breeds.

  5. All dogs must remain on a leash no longer than 4 feet at all times. No retractable leashes please (unless locked at no longer than 4 feet). You may remove the leash when your dog is in the enclosed Zoomies Zone Off-Leash Dog Park, but you must remain with and supervise your dog inside the park at all times. All Attendees agree to not leave their dog unattended at any time.

  6. The Event is intended for friendly, well-socialized dogs. Do not bring dogs that are unpredictable in crowds or with other dogs and/or with strangers. If your dog is having a bad day, please take your dog home. We want the Event to be enjoyable for everyone and reserve the right to ask you to remove any aggressive or unhappy dogs.

  7. There will be special Dog Potty Stations at the Event (look for the red fire hydrants!). Please be courteous and responsible - clean up after your dog and dispose of any waste in the designated Dog waste bins. Dog waste bags will be provided but we suggest bringing your own.

  8. Water stations will be available for your dog, but bring your own food and bowl, if possible, along with comfortable bedding, blanket or mat so both your dog and you can sit comfortably on the grass field in Central Bark. Picnic tables will also be available in various locations, or you can also bring your own collapsible lawn/camping chair.

  9. By participating in the Event, Attendees authorize BarkFest to produce, reproduce, broadcast and otherwise use photography, video, audio recordings, digital images or other likeness of themselves and their dog for BarkFest promotional purposes including media coverage, social media posts, live-streaming, websites and printed materials for an unlimited duration.
